TERMS OF SERVICE FOR PRIVATE COMMISSIONS AND COMMERCIAL WORK
Please review these terms before inquiring. If you have any questions or have any specialized needs not addressed in the terms please contact me directly.
GENERAL TERMS

Prices are subject to change based off of demand

Commercial work (including but not limited to animation, game, comics or merchandise for profit) is charged as double the price of private commissions. A contract is required for this type of work
PAYMENT
-
Payments are made in USD via Paypal
-
I will not begin drawing until payment is received.

When your request is accepted, you will receive an invoice of agreed upon scope of work and price. Requests requiring multiple images will be itemized.

PROCESS &
DELIVERY
-
I will open 3 commission slots at a time and they will not reopen until all 3 are complete. Slots are reserved only when payment is received.

Please allow up to 2 weeks for character art and up to 3-4 weeks for character sheets.

When your requested work is finished, you will receive a full-resolution version of your image(s). Other file formats are available upon request depending upon the nature of the work.
REVISIONS
-
To receive the most accurate depiction of your character, please provide visual references.

3 minor revisions are included in the price.

Major revisions that change the scope of the work (including but not limited to: Style changes, Major clothing, prop or feature changes, Pose changes etc.) may be subject to additional fees
COPYRIGHT &
USAGE

If your project requires discretion, an NDA must be provided before work can be started.

All commercial work must require a contract, master service agreement or statement of work. Work will not begin until all necessary documents are signed by all parties.

Depending on the nature of commercial work, royalties may be negotiated.

I, Jayleen Pulte 'JayJackDraws' (the artist):

I reserve the right to cancel and refund the order at any time for any reason.

I will NOT claim the intellectual property (IP) of the commissioned artwork.

I reserve the right to post the commissioned artwork online including social media and my portfolio.

I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.

You (the customer/commissioner):

You may upload the commissioned artwork on any website and social media. Please provide credit!

You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, NFTs etc.)

You may NOT alter the commissioned artwork without my (the artist's) consent.

You retain the rights to the intellectual property (IP).
-
You may NOT use the commissioned artwork for commercial purposes unless contracts stating otherwise were documented and signed prior to the start of the commission.
The following is considered copyright infringement:​

Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.

Claiming the artwork as your own

Altering the artwork without my consent

Some of these terms may be excluded if a contract is provided, agreed upon, and signed by all parties
CANCELLATION
& REFUND POLICY

The buyer is not allowed a refund once I started working on the commission.

If for any reason I am unable to start your commission you will receive a full refund.

If you cancel your order before I started it, you can get a full refund.

If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.

If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.
